1. Definitions

The following terms are used in these terms and conditions:

  • DotasToys: The trade name of DotasToys, located at Pijlspitskreek 3, 2241 MT Wassenaar, Chamber of Commerce number: 96004177, VAT number NL005189518B08.
  • Customer: The natural person or legal entity that enters into an agreement with DotasToys.
  • Product: All educational toys, printables, e-books, digital products, and merchandise offered by DotasToys.
  • Agreement: The purchase agreement between DotasToys and the customer.
  • Website: www.dotastoys.com and all subdomains.
  • In writing: Communication via email, WhatsApp, or other digital channels.

2. Applicability

2.1 General

These general terms and conditions apply to all offers, orders and agreements between DotasToys and the customer.

2.2 Deviations

Deviations from these conditions are only valid if confirmed in writing by DotasToys.

2.3 Nullity

If any provision of these terms and conditions is found to be invalid, the remaining provisions will remain in full force and effect. DotasToys will replace the invalid provision with a valid provision of similar effect.

2.4 Changes

DotasToys reserves the right to amend these terms and conditions. Amendments will become effective upon publication on the website. Agreements already concluded will continue to be governed by the terms and conditions applicable at the time of the order.

3. Offer and Conclusion of Agreement

3.1 Offer

  • All offers on the website are without obligation, unless stated otherwise.
  • Prices and product descriptions are subject to change without notice.
  • Obvious errors or mistakes in the offer do not bind DotasToys.

3.2 Establishment

  • The agreement is concluded when the customer places the order and DotasToys has confirmed this in writing (by e-mail).
  • DotasToys reserves the right to refuse an order without giving a reason.

3.3 Confirmation

After placing an order, the customer will receive an order confirmation by email within 24 hours. This confirmation includes:

  • Order number
  • Ordered products
  • Total amount (including VAT and shipping costs)
  • Expected delivery time
  • Delivery address

4. Prices and Payment

4.1 Prices

  • All prices on the website are in euros (€) and include VAT, unless stated otherwise.
  • Shipping costs are listed separately and are not included in the product price.
  • DotasToys reserves the right to change prices. Orders already placed will not be affected by price changes.

4.2 Payment methods

DotasToys accepts the following payment methods:

4.3 Payment

  • Payment must be made immediately upon ordering, unless otherwise agreed.
  • When paying afterwards (Klarna), the terms and conditions of the payment provider apply.
  • Until payment has been received, the products remain the property of DotasToys.

4.4 Payment obligation

When you click the button in the last step of the ordering process "Pay" , "To settle" or a similar term, you enter into an agreement with a payment obligation On.

4.4 Payment arrears

⚠️ Please note:

  • In the event of late payment, the customer is in default without any notice of default being required.
  • DotasToys is entitled to charge statutory interest (2% per month) and collection costs.
  • Collection costs amount to a minimum of €40 and a maximum of 15% of the outstanding amount.

5. Delivery and Shipping

5.1 Delivery time

  • Physical products: 1-3 working days within the Netherlands, 2-5 working days within Belgium.
  • Digital products: Immediately after payment via email (within 24 hours).
  • The delivery times stated are indicative and not a deadline.

5.3 Shipping method

  • Shipping via PostNL or DHL.
  • Orders placed before 4:00 PM will be shipped the same business day (if in stock).
  • Track & trace code will be sent by email.

5.4 Delivery

  • Delivery will take place at the delivery address specified by the customer.
  • The customer is obliged to provide the delivery address correctly and completely.
  • In case of absence, a card will be left with instructions for collection or re-delivery.

5.5 Transfer of Risk

The risk of loss or damage passes to the customer upon delivery.

5.6 Delay

  • In case of a delay of more than 14 days, the customer has the right to terminate the agreement in writing.
  • DotasToys is not liable for delays due to force majeure (see article 12).

6. Right of withdrawal (14 days' reflection period)

6.1 Reflection period

You have the right to cancel your order 14 days after the day of receipt to revoke without giving any reason. After this revocation you have the right to revoke again 14 days You will then be credited with the full order amount, including any standard shipping costs paid for the outward journey.

Only the return shipping costs from you to DotasToys are at your own expense, unless otherwise agreed. These costs are approximately €7.25 per package; consult your carrier's website for exact rates.

6.2 Exception: digital products

The right of withdrawal does not apply to digital products (such as e-books, printables, and downloads) if delivery has begun with your express prior consent and you have waived your right of withdrawal. This is the case, for example, as soon as you have downloaded or opened the digital product.

6.3 Exercise of the right of withdrawal

To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract within the cooling-off period. You can do this by:

  • send an email to info@dotastoys.com , or
  • use a (model) withdrawal form that you can send to us by e-mail or via our website.

After receiving your cancellation request, we will send you a confirmation by email.

6.4 Return Conditions

During the cooling-off period, you must handle the product and its packaging with care. You may only unpack or use the product to the extent necessary to determine its nature, characteristics, and functioning, just as you would be allowed to do in a physical store.

If the product is damaged or the packaging is damaged more than necessary to try the product, we cannot refund you. depreciation of the product. Therefore, please handle the product with care and ensure it is properly packaged when returning it.

Where possible, we request that you return the product, if reasonably possible, in its original condition and packaging, including all accessories supplied.

6.5 Refund

We will refund the full order amount, including any standard shipping costs paid for the outward shipment, within 14 days after registering your return return. We may withhold reimbursement until we have received the products back or until you have supplied evidence of having sent back the products, whichever is the earliest.

The refund will be made using the same payment method you used for the initial transaction, unless you expressly agreed otherwise. You will not incur any fees for this refund.

6.6 Exceptions to the right of withdrawal

The right of withdrawal does not apply to:

  • digital products the supply of which has begun with your express consent and where you have declared that you waive your right of withdrawal;
  • custom-made products or products that have been modified according to customer specifications;
  • products which are not suitable for return for reasons of health protection or hygiene and of which the seal has been broken after delivery.

7. Warranty and Conformity

7.1 Conformity

  •  All products meet the usual requirements and standards that may be set for them.
  •  Products are CE certified and comply with EN71 safety standards.
  •  Products are free of BPA, phthalates and other harmful substances.

7.2 Warranty

  • DotasToys guarantees that products are free from material and manufacturing defects upon delivery.
  • Warranty period: 1 year from date of delivery (legal warranty).

7.3 Warranty claim

In the event of a defect, the customer can:

  1. Contact us via info@dotastoys.com
  2. Send photos of the defect
  3. Please state order number and proof of purchase

DotasToys will optionally:

  • Repair the product free of charge
  • Replacing the product
  • Refund the purchase amount

7.4 Excluded from Warranty

Warranty expires in case of:

  • Normal wear and tear
  • Incorrect or careless use
  • Damage due to negligence or accidents
  • Repairs by third parties without permission from DotasToys

8. Complaints

8.1 Complaints procedure at DotasToys

It can always happen that something doesn't go exactly as planned. We recommend that you first report any complaints to us by emailing us at info@dotastoys.com or via the contact form on our website ( https://dotastoys.com/pages/contact/ ).

We aim to resolve your complaint within 14 days We will respond to your inquiry substantively upon receipt. If this unexpectedly takes longer, we will inform you.

8.2 Mediation via WebwinkelKeur

In case of complaints, a consumer should first contact the entrepreneur. If the online store is affiliated with WebwinkelKeur and if complaints cannot be resolved amicably, the consumer should contact WebwinkelKeur ( www.webwinkelkeur.nl ), which will mediate free of charge. 8.3 Complaints periods

9. Liability

9.1 Limitation

  • DotasToys is only liable for direct damage resulting from an attributable shortcoming.
  • Liability is limited to the amount of the order (maximum €500 per event).

9.2 Excluded Damage

DotasToys is not liable for:

  • Indirect damage (consequential damage, lost profits, lost savings)
  • Damage due to incorrect use of products
  • Damage caused by failure to follow instructions or warnings
  • Damage caused by third parties (shipping partners, payment providers)

9.3 Safety

  • Products are intended for children aged 0-9 years under adult supervision.
  • Parents/guardians are responsible for correct and safe use.
  • Warnings and age indications on products must be followed.

10. Intellectual Property

10.1 Copyright

  • All content on the website (texts, images, logos, designs, Dotas the Giraffe) is the property of DotasToys and protected by copyright.
  • It is not permitted to copy, distribute or publish content without written permission.

10.2 Trademark

  • "DotasToys" and "Dotas the Giraffe" are registered trademarks.
  • Use of these marks without permission is prohibited.

10.3 Printables and Digital Products

📄 Terms of Use for Digital Products:

  • Digital products (printables, e-books) are for personal, non-commercial use only.
  • It is not allowed to sell, rent or publicly share digital products.
  • One license is valid for one household or classroom.

11. Privacy and Data Protection

11.2 GDPR

DotasToys processes personal data in accordance with the General Data Protection Regulation (GDPR).

12. Force Majeure

12.1 Definition

Force majeure means any circumstance beyond the will and control of DotasToys that prevents compliance with the agreement.

12.2 Examples

  • Natural disasters, fire, flood
  • War, terrorism, riot
  • Strikes, business disruptions
  • Disruptions in internet, electricity, telecommunications
  • Government measures (lockdowns, import bans)
  • Supplier or shipping partner outages

12.3 Consequences

  • In the event of force majeure, DotasToys is not obliged to fulfil the agreement.
  • Obligations are suspended for the duration of the force majeure.
  • In the event of force majeure lasting longer than 2 months, both parties have the right to terminate the agreement without compensation.

13. Applicable law and disputes

13.1 Applicable law

All agreements between DotasToys and the customer are exclusively subject to Dutch law applicable, even if the customer lives abroad.

13.2 Competent court

Disputes arising from or related to agreements between DotasToys and the customer, for which no solution has been found through the complaints procedure and any mediation, will be submitted to the competent court in the district where DotasToys is established, unless the law prescribes otherwise.

13.3 Disputes Committee and WebwinkelKeur

Before submitting a dispute to a court or disputes committee, the customer must first have completed the complaints procedure at DotasToys and given us at least four weeks to reach a solution.

If DotasToys is affiliated with WebwinkelKeur, consumers can submit unresolved complaints to the independent dispute committee appointed by WebwinkelKeur, as described in Article 8.2 of these terms and conditions. The decision of this dispute committee is binding on both DotasToys and the consumer.
